Sujit Choudhry addresses both the Spanish and Catalonian government on the way forward

Sujit Choudhry has written a letter together to both the Catalan and Spanish governments with the input from other renowned constitutional law scholars. In the letter, Sujit is imploring both the Spanish and Catalan governments to act in good faith while having a meaningful dialogue through which they can discuss their constitutional issues.

The aim of writing the letter is to help both sides avert violence such as the recently witnessed while also emphasizing the need to adhere to the country’s constitution while navigating the desire of Catalonia to have its independence from Spain.

In the letter, Sujit and his associates are urging the president of Catalonia to express his commitment to the secession from Spain. It is a consensus from the constitutional law scholars that The Catalonian president should demonstrate the plea of the Catalonian republic through a referendum. Having the poll will best show the will of the people.

On the letter, the scholars also address the prime minister of Spain to agree to secession if that is what the citizens of Catalonia desire. Other than this the letter urges the prime minister of Spain to let the will of the people prevail without opposition.  Relevant article on patch.com.

Sujit Choudhry and the constitutional law scholars who wrote the letter believe that holding the referendum will sensitize the public on the difficulty that will arise for the Spanish legal order due to Catalonia’s quest for independence. At the end of the letter, the scholars state that both sides need to come up with a settlement that recognizes both the will of the people regardless of the team they support, while at the same time respecting the will of the people of Catalonia.  Additional article on works.bepress.com.
